Montega Media Global Photographer Network

Photographer Referral Program Terms

These terms explain how the Montega Media Global Photographer Network works, including referrals, commissions, assignment acceptance, client relationships, payments, professional standards, and participation by photographers in different countries.

Program summary: There is no membership fee. Montega Media may refer photography assignments to participating photographers. For qualifying completed jobs introduced by Montega Media, Montega Media is entitled to a 10% referral/booking commission on the photography service fee as described below. Participation does not guarantee any minimum number of jobs or income.

1. Eligibility and application

Applicants must be legally able to provide professional photography services where they work. Montega Media may approve, decline, pause, or remove an application or network profile at its discretion. Submission of an application does not create a right to receive assignments.

2. Independent business relationship

Network photographers participate as independent businesses or independent contractors and are not employees, agents, partners, franchisees, or joint venturers of Montega Media. Photographers are responsible for their own business registration, licenses, permits, insurance, taxes, equipment, assistants, travel arrangements, and compliance with laws applicable in their location.

3. No guaranteed assignments

Montega Media does not promise any minimum number, frequency, value, territory, or type of referral. Referrals depend on client demand, location, specialty, availability, quality, pricing, and other factors relevant to the assignment.

4. Assignment offers and acceptance

Each assignment is separate. When possible, Montega Media will provide the available scope, date, location, deliverables, timing, client requirements, compensation, payment structure, and other material details before acceptance. A photographer may accept or decline an offered assignment. Once accepted, the photographer is expected to perform according to the agreed job terms.

5. Montega Media 10% referral/booking commission

For a qualifying assignment introduced by Montega Media and accepted through the network, Montega Media is entitled to a commission equal to 10% of the gross photography service fee actually paid for that completed assignment, unless a different written arrangement is agreed before the job.

Unless otherwise agreed in writing for a specific assignment, the commission calculation excludes separately stated sales tax, VAT/GST, government permit charges, and approved pass-through travel or third-party expenses that are reimbursed at cost rather than paid as photography compensation.

If Montega Media collects the client's payment, Montega Media may deduct its 10% commission before remitting the photographer's share. If the photographer collects the client's payment directly on a Montega-referred job, the photographer agrees to remit the applicable commission to Montega Media according to the payment instructions for that assignment.

6. Repeat work with referred clients

For six months after Montega Media first introduces a photographer to a client, photography work directly resulting from that introduction is considered a Montega-referred relationship for purposes of the 10% commission, unless Montega Media confirms otherwise in writing. This provision is intended to protect the referral relationship while allowing photographers to build productive client relationships.

7. Pricing, expenses, and payment

Pricing may be proposed by the photographer, Montega Media, or the client depending on the assignment. No assignment is final until the relevant job terms are accepted. Photographers should not incur unusual travel, rental, permit, assistant, location, or production expenses without approval when reimbursement is expected. Payment timing and method may vary by assignment and client.

8. Professional standards

Photographers are expected to communicate professionally, arrive prepared and on time, maintain suitable equipment and backups, follow reasonable client instructions, behave respectfully, protect client property and confidential information, and deliver work according to the agreed specifications and schedule.

9. Portfolio, intellectual property, and usage rights

Copyright ownership and client usage rights may vary by assignment. Any job-specific license, work-made-for-hire requirement, confidentiality restriction, embargo, model/property release requirement, or transfer of rights will be communicated as part of the assignment terms when applicable. Photographers must not publish confidential or restricted client work without permission.

10. Insurance and equipment

Photographers are responsible for maintaining equipment, liability, vehicle, workers' compensation, travel, or other insurance appropriate to their business and jurisdiction. Montega Media may request proof of insurance for certain assignments.

11. International photographers

The network is open to photographers in many countries. Each photographer is responsible for determining whether they may legally perform the assignment, invoice for services, receive payment, travel, work across borders, and satisfy local tax, immigration, employment, privacy, consumer, and business requirements. Local mandatory laws may override portions of these terms where applicable.

12. Applicant and network data

By applying, the photographer authorizes Montega Media to store and use the information submitted for application review, network administration, assignment matching, communication, payment administration, and related business purposes. Photographers should provide only business information they are comfortable using for these purposes.

13. Client information and confidentiality

Client contact details, schedules, locations, creative briefs, pricing, event information, production documents, and other non-public information shared through the network must be treated as confidential and used only for the relevant assignment unless otherwise authorized.

14. Cancellations and disputes

Cancellation, rescheduling, refund, kill-fee, weather, travel, and force-majeure terms may differ by assignment. The job-specific written terms control when they address an issue differently from these general network terms.

15. Removal from the network

Either party may end future participation in the network at any time. Ending participation does not cancel obligations arising from assignments already accepted, completed, invoiced, or paid, including any commission that has already become due.

16. Limitation of the referral relationship

Montega Media is not responsible for a photographer's independent business expenses, tax obligations, equipment loss, personal injury, local legal compliance, or commitments made outside an accepted Montega Media assignment. Job-specific written agreements may allocate responsibilities differently.

17. Changes to these terms

Montega Media may update these network terms as the program develops. Material changes should apply prospectively and may require renewed acceptance before future assignments.

18. Governing law

Except where mandatory local law requires otherwise, these terms are intended to be governed by the laws of the State of Nevada, United States, without regard to conflict-of-law rules. Any job-specific agreement may establish additional or different dispute terms.
